1. In these terms and conditions the term "Supplier" refers to Tom Bible.
  2. These are the terms and conditions that you must follow if you use the Supplier's site. Please read this agreement in its entirety before you continue to use this web site. Your use of our site indicates your acceptance of these terms and conditions. Please discontinue using the web site if you disagree with the terms and conditions outlined.
  3. All text, photography and software, which appear on the supplier's web site is copyright protected. Downloading of images, text or information without prior permission from the Supplier will be considered a breach of copyright and will result in legal action.
  4. No variation of terms or conditions set out herein shall be effective unless agreed in writing by both parties.
  5. Pictures, Digital Production and Text are supplied (whether via the Supplier's web site or otherwise) on loan and no property or copyright in any pictures shall pass to the Client whether on its submission or on the Supplier's grant of reproduction rights in respect thereof.
  6. Reproduction rights are strictly limited to the use, period of time and territory specified on the Supplier's invoice and unless otherwise agreed in writing relate to a single publication in a single size with text (if any) in one language only.
  7. Reproduction rights granted are personal to the Client and may not be assigned, nor may any picture submitted to the Client be loaned or transferred to third parties save for the purpose of the exercise by the Client of such reproduction rights.
  8. Any reproduction rights are granted by way of licence and no partial or other assignment of copyright shall be implied.
  9. Until the Supplier has invoiced the reproduction fee, neither party is committed to grant or to acquire any reproduction rights in any picture. After a fee has been agreed and an invoice issued there is a firm and binding contract whereby the Supplier is committed to grant reproduction rights and the Client to acquire them.
  10. If payment is not made in accordance with section 9, then the Supplier may rescind this Agreement and recover damages. All payments must be made in the currency indicated on the Supplier's invoice. Delayed payments will lead to additional charges for interest and extra administrative expenses.
  11. Electronic use, storage or transmission of images is forbidden without the express written permission of the Supplier.
  12. Neither Pictures, nor Digital Production nor Texts be altered or manipulated, added to, or have any part deleted without the prior written consent of the Supplier.
  13. While the Supplier takes all reasonable care in the performance of this Agreement generally, the Supplier shall not be liable for any loss or damage suffered by the Client or by any third party arising from use or reproduction of any picture or its caption.
  14. Pictures, Digital Production and Texts are the Client's responsibility from the time they are received until they have been returned to the Supplier.
  15. Under no circumstances may the Client alter or add to or manipulate a photograph by means of computer or any other technique or reproduce a picture in whole or in part as an element within another picture without the Supplier's consent. The Copyright, Designs and Patents Act, 1988, protect such alterations of a picture.
  16. This agreement shall be subject to and construed according to English law and the parties agree to international copyright laws accept the exclusive jurisdiction of the Courts of England.
